Kerala actor assault case: High Court Division Bench upholds single judge’s dismissal of Dileep’s plea for CBI probe insidelooknews

A Division Bench of the Kerala High Court on Monday (April 7, 2025) upheld a single judge’s verdict dismissing a plea of Malayalam film actor Dileep, one of the accused in a case relating to the sexual assault on a woman actor, for a CBI probe in the case.

The Bench comprising Justice A. Muhamed Mustaq and Justice P. Krishnakumar upheld the decision while disposing of an appeal filed by the actor against the single judge’s verdict. The actor had also sought to expunge certain observations made by the single judge in the judgments.

The court, however, observed that certain observations of the single judge were unnecessary. The Bench said that unless the trial is concluded, the observations were unnecessary in a matter such as this.

The special government pleader submitted that the single judge made the observations in the context of rejecting Dileep’s plea for CBI probe and would not have any consequences on the ongoing trial.

Dileep’s contention

According to the actor, the investigation was “unfair, tainted, mala fide and the truth was suppressed.” It was contended by the petitioner that his mother, while he was in jail, and after his release, himself, had submitted representations to the government, claiming innocence and that he was falsely implicated.

He alleged that immediately after the incident, there was a “concerted effort” to spread rumours about his involvement and to get him implicated in the criminal case. It was also alleged that attempts were made to blackmail the petitioner by the first accused and threatened to implicate him in the crime. Since he did not oblige, the first accused implicated the petitioner in the crime. 

According to the petitioner, he had lodged a complaint with the DGP in this regard However, no investigation was conducted. He also alleged that undue influence was exerted on the investigation agency. The IG of the Police departmemt who was the supervising officer was sidelined and the investigation was carried on by a few police officers who had the “ultimate aim of framing” the petitioner in the case. Therefore, he sought a CBI probe in the case.
